Shop & Establishment Registration

The Karnataka Shops & Commercial Establishments Act 1962 deals with shops and commercial establishments in the state. It primarily regulates their operation. The Act was introduced with the aim of regulate the conditions of work of people employed in these establishments. This includes the following factors:

Employees working hours
Yearly & monthly leaves with wages
Wages and compensation
Employment of women and children and other aspects

Thus, as you can see, the Act covers almost all the aspects of the work that done by these establishments.

A Shop shall mean any premises where any trade or business is carried on or where services are rendered to customers, and includes offices, storerooms, go downs, or warehouses, whether in the same premises or otherwise, used in connection with such trade or business, but does not include a commercial establishment or a shop attached to a factory where the persons employed in the shop fall within the scope of the Factories Act, 1948.
A Commercial Establishment shall mean a commercial or trading or banking or insurance establishment, an establishment or administrative service in which person employed are mainly engaged in office work, a hotel, restaurant, boarding or eating house, a café or any other refreshment house, a theatre or any other place of public amusement or entertainment and includes such establishments as the State government may by notification declare to be a commercial establishment for the purpose of this Act.
Each owner, within 30 days from starting the business shall submit application form in form ‘A’ to register his establishment.

Normally the labour department of the state government governs the Act. This means that you have to apply for shop registration of your business with the respective local labour officer in your district. Suppose your business place is Bangalore, then you’ve to apply in Bangalore labour department.
If your business is eligible to register under the Act you would have to apply for registration within a span of 30 days of starting your business.
Here’s some steps are involved in this process:
Visit to e-Karmika website;
Click on “New Registrations”; enter the information regarding your business, security code and click on “Submit” button;
Login with received “Username and Password” to your given Mobile No and Email, click on “Registration (Part-A)” and fill the form & upload scanned documents;
Make online payment consequently;
Submit the physical “acknowledgement copy of application” to your respective circle officer with payment challan, documents and get the certificate;

The documents required for obtaining the shop and establishment registration certificate is-

Shop or Business establishment address proof.
ID proof of the proprietor.
PAN Card of the proprietor.
Details of the employees.
Payment challan.
Additional business licenses necessary for starting the business, if any.
